1. Provider and scope
These terms apply between you and the provider of Lane Shooter: Zombie Squad (“Lane Shooter”):
- Alex Viktor Heinrich, c/o Block Services, Stuttgarter Str. 106, 70736 Fellbach, Germany
- Email: laneshooter@mizustudio.dev
- Phone: +49 163 1603720
They govern the use of the game Lane Shooter. By downloading or using the game you enter into a user agreement with us under these terms. Your contract with the App Store or Google Play is additionally governed by the terms of that store.
2. What Lane Shooter is
Lane Shooter is an action game: you steer a squad of soldiers through gates, against zombie hordes and bosses. The game is free and shows ads, namely reward videos that you start voluntarily and short ad breaks between runs. Optionally you can buy gems, bundles and “No ads”; the game shows what a purchase includes before you buy.
There is no account. Your progress is saved on your device only.
3. Licence
You receive the non-exclusive, non-transferable right to use Lane Shooter on devices that you own or control, within the usage rules of your store. The software, characters, images, music, sounds and texts remain our property or that of our licensors. You may not extract them from the game, pass them on or use them outside the game. Statutory rights, for example under Sections 69d and 69e of the German Copyright Act, remain unaffected.
4. In-game purchases
On offer are consumable purchases such as gems and the piggy bank, and one-time purchases such as “No ads”, the starter pack and the complete pack. There are no subscriptions. The price and content are shown in the game and in the store before you buy; the price may differ by country.
The purchase is handled by your store: in the European Economic Area, Apple Distribution International Ltd. for the App Store and Google Commerce Limited for Google Play. You pay through your account with the store. Payment, invoicing and refunds are governed by the store’s terms.
One-time purchases such as “No ads” apply permanently to your account with the store. You restore them in the game under Settings → Restore purchases. Consumable purchases are credited to your game progress. Because your progress is saved on your device only, they are lost when you delete the game or change devices, and they cannot be restored.
5. Right of withdrawal
As a consumer you generally have a statutory right to withdraw from purchases in the store within 14 days. You exercise it towards the store that handled the purchase; there you also find the withdrawal information and the cases in which the right ends early, for example when the supply of digital content begins with your consent. With Apple this is done at reportaproblem.apple.com and with Google Play through the refund request in your Google Play account.
6. In-game currency and content
Coins, gems, upgrades and other content of the game exist only in the game. They have no monetary value, are not paid out and cannot be transferred or exchanged.
We may change game rules, rewards and values in the game for the future, for example to keep the game balanced. This does not take away anything you have bought.
7. What is not allowed
- manipulating the game, purchases or unlocks, or distributing modified versions of the game,
- copying content such as characters, images or music out of the game and passing it on,
- attacking or overloading our website or our servers, or circumventing protective measures,
- sending unlawful content through the contact form.
8. Children and teenagers
Lane Shooter has no minimum age. Anyone who is not yet of age uses the game with the agreement of their parents or guardians. This applies in particular to purchases and to consent to advertising. Purchases can be restricted in the device settings: on iPhone through Screen Time, on Android through Google Play and Family Link.
9. Updates and changes to the game
We provide the updates that are needed for Lane Shooter to remain in conformity with the contract and announce them through the store. Install them promptly. We are not liable for defects caused solely by the fact that an update we provided was not installed (Section 327f of the German Civil Code).
We may change Lane Shooter where there is a valid reason, such as new requirements from Apple or Google, new operating systems, security, a change in the law or the further development of the game. This costs you nothing. If a change impairs the use of something you bought more than insignificantly, we inform you beforehand; you can then end the contract free of charge within 30 days (Section 327r of the German Civil Code).
If we discontinue Lane Shooter, we announce this with reasonable notice. Your statutory rights remain unaffected.
10. Defects and feedback
The statutory rights for defects in digital products apply (Sections 327 et seq. of the German Civil Code). The easiest way to report a problem is in the game under Settings → Help & contact, or by email.
We may use suggestions and hints you send us to improve Lane Shooter. This creates no claim to their implementation or to payment.
11. Liability
We are liable without limit for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and where we have given a guarantee.
For slight negligence we are liable only if we breach an essential duty, that is, a duty whose fulfilment makes the contract possible in the first place and on which you may rely. Liability is then limited to the damage that is typical and foreseeable for a contract of this kind. Otherwise liability for slight negligence is excluded.
12. Apple App Store
If you downloaded Lane Shooter from Apple’s App Store, the following applies in addition:
- These terms are concluded between you and us only, not with Apple. We alone, not Apple, are responsible for Lane Shooter and its content.
- Your licence is non-transferable and covers Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Other accounts may use Lane Shooter through Family Sharing or volume purchasing.
- We alone provide maintenance and support. Apple has no obligation to do so.
- We alone are responsible for any warranty. If Lane Shooter fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price to you. Beyond that, to the maximum extent permitted by law, Apple has no warranty obligation for Lane Shooter.
- Claims by you or third parties relating to Lane Shooter are addressed to us, not to Apple. This includes product liability claims, claims that Lane Shooter fails to conform to a legal or regulatory requirement, and claims under consumer protection or privacy law.
- If a third party claims that Lane Shooter infringes its intellectual property rights, we alone, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
- You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that the U.S. Government has designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- When using Lane Shooter you comply with the third-party terms that apply to you, for example those of your mobile contract.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept the terms, Apple has the right to enforce them against you as a third-party beneficiary.
- Questions, complaints and claims about Lane Shooter go to the address, email address or phone number in section 1.
As long as no custom licence for Lane Shooter is on file in the App Store, Apple’s standard end-user licence applies to the game on iPhone alongside these terms: www.apple.com/legal/internet-services/itunes/dev/stdeula
13. Google Play
If you downloaded Lane Shooter from Google Play, purchase and payment are additionally governed by the Google Play Terms of Service.
14. Changes to these terms
We may adapt these terms for the future where there is an objective reason, such as new features, new requirements from the stores or a change in the law. The current version is on this page with its date; we announce material changes in the game or through the store. Changes that shift the balance between what you get and what you pay to your disadvantage apply only with your consent.
15. Law, dispute resolution and language
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you live in another country as a consumer, you keep the protection of the mandatory provisions of the country where you habitually reside.
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
If the language versions differ, the German version applies. Should a provision be invalid, the others remain in force.
